Terms of Service

The baseline rules for authorized, professionally supervised use of ForensicTrail.

Effective date
October 13, 2026
Version

Launch review: These Terms intentionally do not invent governing law, venue, indemnity, warranty, liability, insurance, payment, or contracting-entity provisions. The business and counsel must approve those terms in the customer agreement before launch.

Agreement and authority

These Terms of Service govern access to ForensicTrail. By accepting them, the user confirms that they are authorized to use the selected customer organization's workspace and to submit the information they provide. Acceptance is recorded by user, organization, document version, published-content hash, timestamp, and request context.

Professional responsibility

ForensicTrail organizes evidence and produces review aids. It is not a law firm, accounting firm, court, consumer-reporting agency, or substitute for professional judgment. Users are responsible for validating source records, classifications, calculations, citations, exports, legal theories, filing requirements, and any opinion or representation made to a client, court, regulator, or other person. The service does not promise admissibility or a particular outcome.

Permitted use

  • Use the service only for matters the customer is authorized to handle and only in compliance with law, professional duties, court orders, and contractual restrictions.
  • Do not upload information obtained without authorization, attempt to access another organization or matter, bypass access controls, probe the service, introduce malicious code, or use the service to make an automated eligibility or legal decision without appropriate human review.
  • Credit-report and protected-identifier workflows require their additional consent, purpose, and access controls.

Customer data and instructions

The customer retains its rights in material it submits. The customer authorizes ForensicTrail and its subprocessors to host, copy, transform, analyze, and transmit that material only as needed to operate, secure, support, and improve the contracted service, subject to the governing commercial agreement. The customer is responsible for its users, permissions, notices, consents, preservation duties, and deletion instructions.

Accounts and organizations

Accounts are individual and may not be shared. Access is scoped by organization membership and role. A user who belongs to multiple organizations accepts required legal versions separately for each one. Invited users must accept before normal use. A read-only organization may accept and read existing material but cannot create ordinary new work. A suspended organization cannot enter the workspace; users can still sign out and read the public legal documents.

Service changes and availability

Features, provider configurations, and limits may change. Maintenance, provider failures, security events, or legal requirements can interrupt access. We do not promise uninterrupted or error-free operation. Material changes to these Terms receive a new version; earlier acceptance evidence remains unchanged.

Confidentiality and security

ForensicTrail applies the technical controls described in the Privacy Policy and security documentation. Customers should use appropriate least-privilege roles, remove former users promptly, avoid unnecessary sensitive uploads, and maintain their own matter-management and preservation practices. No SOC 2 report, certification, Zero Data Retention arrangement, or universal no-training guarantee is represented unless stated in a separately signed agreement.

Fees, term, suspension, and deletion

Commercial fees, subscription term, renewal, retention, support, and termination terms belong in the signed order form or other customer agreement. The service may restrict writes when a subscription is read-only and may suspend access for security, legal, or contractual reasons. Data deletion is subject to preservation duties and the residual backup, version, audit, and log periods described in the Privacy Policy.

Disclaimers and allocation of risk

The service is provided subject to the warranties, disclaimers, indemnities, liability limits, insurance requirements, and remedies in the signed customer agreement. Those provisions are not supplied here because they require an explicit business and legal decision; they must be completed and approved by counsel before launch. Nothing here waives rights that cannot lawfully be waived.

Governing terms and contact

If these Terms conflict with a signed customer agreement, the signed agreement controls for that customer. Governing law, venue, dispute process, notice addresses, and contracting entity must be set in the signed agreement and reviewed by counsel before launch. Questions may be submitted through the Contact page.
